How to apply for Planning Permission

You apply to your council for planning permission. Planning applications are decided in line with the development plan unless there are very good reasons not to do so. Points that will be looked at include the following:

  • number, size, layout, siting and appearance of turbines;
  • proposed means of access, visual impact on the neighbourhood;
  • availability of access and power;
  • proposed use of the development.

It is not necessary to make the application yourself. If you wish, you can appoint an agent (for instance, an architect, a solicitor, or a builder or TAEC) to make it for you.

Anyone can make an application, irrespective of who owns the land or buildings concerned. However, if you are not the owner, or if you have only part-ownership, you have to inform the owner or those who share ownership, including any leaseholder whose lease still has seven or more years to run, and any agricultural tenant.

TAEC Planning Consultancy Service ..

TAEC work in partnership with several specialist planning consultants with experience in handling Alternative Energy project proposals. There are varying levels of service based on customer requirements or budgets. Examples: plans

A. Viability - Planning Consultant visits the site, meet the client to understand their requirement and objectives, examine LPA policies (renewables policy and area specific policies, such as Green Belt, Area of High Landscape Value, etc), consult LPA Planning Officer where possible , produce a short report to give a recommendation on the prospects of the proposal gaining planning permission - £400 plus VAT

B. Planning Application - Hourly rates of £95 to £110 per hour exclusive of travelling costs, out of pocket expenses and VAT.

A standard fee for dealing with single wind turbine applications as a fixed fee of £1,500 exclusive of vat. This fee would cover all the planning aspects of preparing, submitting and negotiating an application. This would include :

Preparation of the planning application including forms, Planning Statement and Design and Access Statement.

Submission of the application. Regular monitoring of the application as it progresses and dealing with any issues that may arise.

Attendance/speaking at Committee if this is required.

(Larger schemes may entail a larger fee as the work is likely to be greater).

The fees only relates to planning work and does not include any other supporting information required for example cost of noise reports, or landscape visual impact assessments etc.

C. Appeals - If a planning appeal is required, would advise on the most appropriate procedure.  A Written Representations appeal would be £1,200 plus VAT and a Hearing £1,600 plus VAT. If an appeal is dealt with under the Public Inquiry procedure (unlikely, but possible) it would require a separate fee quote to agree a budget for these prior to commencement.

If any additional work is required over and above these, it would be charged at £95 - £110 per hour or a day rate of £450 plus VAT.
